News Release: U.S. Patent and Trademark Office Removes Secrecy Orders From HiEnergy Technologies'Patent Applications for Supersenzor

HiEnergy Technologies, Inc. (OTC Bulletin Board: HIET) today announced that the U.S. Patent and Trademark Office (USPTO), in response to HiEnergy's petition, rescinded secrecy orders from patent application for the 'atometer,' (commercial name: SUPERSENZOR), with the authorization of the U.S. Army.

'This opens up the world markets for our Megasenzor and Supersenzor,'said Dr. Bogdan Maglich, Chairman and Chief Scientist. 'We now can accept Purchase Orders from abroad which we weren't even able to discuss with foreign customers since last November. Recently, we were offered good opportunities to promote our product in Asia.' In November 2002, HiEnergy Technologies, Inc., received seven Secrecy Orders pursuant to 37 C.F.R. subsection 5.2 from the U.S. Patent and Trademark Office (USPTO) with regard to its U.S. patent applications and PCT applications. The Secrecy Orders impacted pending patent applications 09/788,736 and 09/883,851. These patent applications were identified by the U.S. Army as containing subject matter classifiable at the level of 'SECRET.' Under a Secrecy Order, the subject matter of an application may not be published or disclosed except as specifically authorized pursuant to 37 C.F.R. subsection 5.5. Six of the Secrecy Orders were issued on October 18, 2002 and one was issued on October 22, 2002.

HiEnergy petitioned for rescission of the Secrecy Orders on the grounds that identical patent applications were submitted to European and Japanese Patent Offices as far back as 1999 which, in turn, had already made them public prior to the issuance of the Secrecy Orders.

'The advantage of foreign sales of Megasenzor and Supersenzor series is that it will allow us to sell early commercial prototypes, known as 'Beta models', in Asia, the Middle East, and some European countries, and thereby accumulate the experience required for U.S. certification,'said Dr. Maglich.
